Terms and Conditions for the option chosen
1. Definition
1.1 “Client” is the person or identify who sign this application form.
1.2 “Mr Sekerheid Prepaid” is Mr Sekerheid Prepaid (Pty) Ltd with registration number 2015/006186/07.
1.3 “Consumer” is the owner/tenant of the premises as indicated on the residential address of the application.
2. According to this agreement the following services will be supplied by Mr Sekerheid Prepaid (Pty) Ltd:
2.1 Installation of the sub-prepaid meter(s) at the installation address for the management of electricity supply.
2.2 The consumer will purchase tokens (electricity) via electronic means at any EasyPay outlet and/or bank deposit to Mr Sekerheid Prepaid (Pty) Ltd. The tokens will be used on the prepaid meter installed at the residential address for the means of continuous electricity supply at the residential address.
2.3 The prepaid meter does not replace the municipality electricity meter.
2.4 Mr Sekerheid Prepaid (Pty) Ltd will not accept any responsibility for interruption of electricity supply due to circumstances beyond its control if such interruptions are authorized by the municipality.
2.5 It is the owner’s responsibility to pay the municipality account on/before the due date, as the electricity purchases will be seen as a reimbursement.
2.6 As per legislation no person or institution is allowed to profit from the consumption of electricity as prescribed by the by-laws of Nersa and Mr Sekerheid Prepaid is authorized to charge a transaction fee as well as a monthly service fee of R42,99 for services provided.
2.7 The supply of electricity is subject to municipal by-laws and other legislation and must be strictly adhered to by all parties.
2.8 Monies received by Mr Sekerheid Prepaid (Pty) Ltd will only be paid to the owner/investor as per application form. The owner/investor are solely responsible for the municipality account.
2.9 The ownership of the prepaid meter will only be transferred to the owner after the prepaid meter are paid in full. Please take note that the software of the prepaid meter is the software of Mr Sekerheid Prepaid (Pty) Ltd.
3.1 The agreement will be in place after the installation are done, until terminated by either party by given a three months’ written notice.
3.2 If there is no notice given of the prepaid meter cancellation, an admin fee will be charged in the amount of 3 months vending that will be due to Mr Sekerheid Prepaid (Pty) Ltd.
4. Replacement of prepaid meter:
4.1 The prepaid meter will not be replaced should it become faulty due to tampering, interfering with the operation thereof, abuse or use of the contrary to the instructions of the manufacturer and/or Mr Sekerheid Prepaid (Pty) Ltd. In these cases, a new meter will only be installed by Mr Sekerheid Prepaid (Pty) Ltd at the full replacement value payable by the owner.
4.2 The owner will be responsible to recover all the cost from the party responsible for the damage and replacement. Mr Sekerheid Prepaid (Pty) Ltd will not perform any repairs to any meters or replace any meters not installed by Mr Sekerheid Prepaid (Pty) Ltd.
5. Any changes to this agreement are null and void unless both parties signed in writing.
6. This agreement constitutes the entire agreement between both parties:
6.1 Authorization: We hereby appoint Mr Sekerheid Prepaid (Pty) Ltd to manage sales and control the sales of the electricity. We undertake to notify Mr Sekerheid Prepaid (Pty) Ltd of any changes of the abovementioned details change, Mr Sekerheid Prepaid (Pty) Ltd do not take any responsibility if the details provided are incorrect, for example incorrect banking details supplied.
6.2 Meter tariffs: Mr Sekerheid Prepaid (Pty) Ltd adhere to the code of practice of NERSA (National Energy Regulator of South Africa). All our meters are correctly programmed as per the tariff’s schedules of the various municipalities.
6.3 Service and penalty fees: I acknowledge that there is per transaction a 10.09% transaction service fee (excluding VAT and third-party fees) depending on vending channel used. This will be deducted from each transaction request. There is also a monthly metering fee of R49.99 per meter charged on the first purchase of each month. If the premises are empty, it is the owner’s responsibility for the monthly metering fee to be paid. This is the cost for the tenant and will not affect the electricity pay-out.
6.4 Liability: Mr Sekerheid Prepaid (Pty) Ltd only renders services to the owners and will not get included in any disputes between the owners and tenants or for any legal action taken by tenants. Mr Sekerheid Prepaid (Pty) Ltd assist an owner/landlord to manage his property with the use of prepaid meters, but cannot be held liable for any outstanding accounts, since there are numerous reasons why and account can be in arrears. Mr Sekerheid Prepaid (Pty) Ltd’s responsibility is to ensure that all the monies for purchase electricity gets paid to the owner, and it is the owner’s responsibility to pay the relevant municipalities.
6.5 Meter inspections: By-pass notifications gets send to owner’s via e-mail correspondence or telephonically, or any tampering of the prepaid meters. Meter inspections will only be done if accompanies by an owner or managing agent. Mr Sekerheid Prepaid (Pty) Ltd will not inspect prepaid meter at dangerous sites or where life threatening situations exist. All meter inspections will be charged at R750.00 and must be paid before inspection. According to the law there must be an inspection at the premises every six months. The inspection will require a change of the seal of the prepaid meter. The cost for this will be R550.00.
6.6 Warranty: Prepaid meters have a 1 (one) year warranty from the date of instillation.
6.7 Correspondence: All correspondence will be in writing to the owner of the property and not the tenant as the mandate is with the owner of the property. All correspondence to Mr Sekerheid (Pty) Ltd will be in writing to the following e-mail address admin@prepaidadmin.co.za. It is the owner’s responsibility to communicate with the tenants.
6.8 Cancellation: This agreement can only be cancelled after 3 months of the date of installation and must be done in writing.
6.9 Change of service provider: A cost of R350.00 will be charged per change-over (per prepaid meter) before any change-over will take place.
7. Warranty/Suretyship
7.1 I/We by appending my signature hereto, I recognize the fact that Kemp de Beer Attorneys has been appointed by Mr Sekerheid Prepaid (Pty) Ltd to act on their behalf should any accounts remain unpaid and for the collection of any arrear payments. Any legal fees incurred in the collection of unpaid accounts will be for the owner’s cost on an attorney and client basis scale.
8. The best option is to purchase electricity directly from our offices. Please take note of the following hours for purchasing electricity:
Weekdays: 7:00 - 21:00
Saturdays: 08:00 – 13:00 and then from 18:00 - 20:00
Sundays: 9:00 – 11:00 and then from 18:00 - 20:00.
